Website Terms of Use and Limited License

Effective November 3, 2026

1 Scope and acceptance

These terms apply to thenurturedmindpsychiatry.com and the practice pages and general inquiry tools operated by Nurtured Mind Psychiatry & Wellness (the practice, we, or us). They cover website use only. They do not replace informed consent, telehealth consent, the clinical Notice of Privacy Practices, or a separate financial or treatment agreement. Where an agreement checkbox is presented, selecting it and submitting the form signifies agreement to the version linked there. Simply reading publicly available information does not, by itself, signify agreement to a waiver of legal rights. If you do not agree, do not use the form; you may call the practice instead.

2 Information and clinical care

Website content is general educational and practice information. It is not an individual diagnosis, prescription, treatment recommendation, or substitute for a qualified clinician's evaluation. Do not start, stop, or change medication or supplements based only on this website. Visiting the site or sending an inquiry does not create a provider-patient relationship. Existing patients retain their rights and obligations under their clinical agreements; this website does not end or modify that relationship.

3 Emergencies and response times

Do not use the general inquiry form for emergencies, urgent symptoms, medication problems, or time-sensitive clinical requests. The form is not continuously monitored, and no response time is guaranteed. In an emergency, call 911 or go to the nearest emergency department. For patient care, use the SimplePractice patient portal or call the practice at (910) 363-2877. These instructions do not reduce any duty the practice has under an existing treatment relationship or applicable law.

4 Eligibility and scheduling

The general inquiry form is for adults age 18 or older. A parent or guardian may ask about general practice processes without identifying a child or sending health information. This restriction does not determine a minor's legal rights to clinical care. Appointment requests go through the patient portal or practice staff and are subject to availability and acceptance. A website submission, automated confirmation, or email receipt does not reserve an appointment or guarantee care, coverage, or a particular outcome. Clinical care is subject to applicable licensure and location requirements; the website describes services in North Carolina.

5 General inquiries and email copies

Provide only your name, email address, optional phone number, general inquiry topic, and a nonsensitive message. Do not include a patient's identity or health details, diagnoses, symptoms, medications, medical records, insurance identifiers, Social Security numbers, payment-card information, or another person's confidential information. Use SimplePractice or call for patient-specific matters. Do not submit information on someone else's behalf without authority.

When you submit the form, your inquiry is saved through ChatGPT Sites and an email copy is attempted through Resend to Catvalenciacnm@gmail.com for practice review. Those service providers and the receiving email provider process the information as needed to provide their services. Submitting the form authorizes this routing and a response to your general question using the contact details you provide. It is not consent to marketing, a HIPAA authorization, or consent to clinical communications by ordinary email. Email delivery can fail or be delayed; the inquiry may still be saved. Call the practice if you need to confirm receipt.

6 Privacy and access to saved inquiries

The Website Privacy Notice and Cookies and External Services notice explain website data handling. Review them before submitting information. These website notices are separate from the practice's clinical Notice of Privacy Practices and do not remove statutory privacy rights. The general inquiry form is not intended for protected health information. Do not rely on a disclaimer as a substitute for using the appropriate patient-care channel.

The saved-inquiry area is restricted to specifically authorized practice accounts. Signing in does not authorize anyone else to access inquiries. Do not share account access, impersonate an authorized person, attempt to bypass access controls, or obtain another person's inquiry. If you notice an access or privacy problem, contact the practice without forwarding sensitive information through the form.

7 Limited license and acceptable use

Subject to these terms and applicable law, we permit you to access the website and view, download, or print reasonable portions of public content for personal, noncommercial reference. This limited, nonexclusive, nontransferable permission does not transfer ownership. The practice and its licensors retain rights in protected text, photographs, logos, designs, and code. Preserve applicable ownership notices. Statutory exceptions, fair use, lawful quotations, and rights in your own submissions remain unaffected.

Do not upload malicious code; send spam; submit intentionally false information; use the site unlawfully; interfere with its operation; overwhelm it with automated requests; circumvent rate limits; or access nonpublic systems without authorization. Ordinary search-engine indexing and lawful assistive technology use are permitted. We do not claim ownership of your inquiries or honest reviews. No provision prohibits truthful reviews, lawful complaints, reporting concerns to regulators, or cooperating with authorities.

8 External services and financial terms

SimplePractice, Google Maps, ChatGPT sign-in, and other linked services have separate terms and privacy practices. A link does not guarantee that a service will always be available or endorse all of its content. Review its notices before sharing information. This provision does not eliminate any duty we have concerning services we select or use. This website does not process payments. Clinical fees, insurance participation, cancellations, missed appointments, and refund eligibility are governed by the practice's separately provided financial agreement and applicable law. Verify current coverage and any authorization requirements with the practice and your insurer.

9 Availability and limited warranty disclaimer

We aim to keep public information accurate, but services, insurance participation, availability, and website content may change. Contact us to confirm information material to your decision. To the extent permitted by law, the informational website is provided as available, without a promise that it will be uninterrupted, error-free, or suitable for every purpose. No website statement guarantees a clinical outcome. Nothing in this section disclaims a professional standard of care, a duty of confidentiality or security, an express commitment in a separate agreement, or a warranty or remedy that cannot lawfully be excluded.

10 Limits of responsibility

To the extent permitted by applicable law, the practice is not liable for indirect, incidental, special, or consequential damages arising solely from use of, or inability to use, the informational website. This limitation does not apply to clinical malpractice, personal injury, fraud, intentional misconduct, gross negligence, breach of confidentiality or privacy duties, or any liability or remedy that the law does not allow the parties to limit. These terms do not require you to waive patient rights, release future clinical negligence claims, or accept a zero-dollar liability cap. You remain entitled to remedies available under applicable law.

11 Website restrictions and continuity of care

We may restrict or suspend website features when reasonably necessary to address misuse, security risks, maintenance, or legal requirements. Any restriction on website access does not itself terminate an existing treatment relationship, deny rights of access to records, or change our obligations for continuity of care. Contact the practice by telephone for an alternative way to communicate or obtain accessibility assistance.

12 Governing law and resolving concerns

North Carolina law and applicable federal law govern these website terms, without displacing mandatory protections that apply to you. We encourage you to contact the practice to resolve website concerns, but contacting us is not a condition of bringing a lawful claim or complaint. These terms do not require arbitration, waive a jury trial or class-action rights, shorten a statutory claim period, or restrict access to a court or regulator with lawful authority.

13 Changes and interpretation

We will identify an updated version and effective date when these terms change. Changes operate prospectively and do not alter accrued claims. When a change requires agreement, we will request affirmative acceptance before applying it to the relevant form or restricted feature. If a provision is unenforceable, the remaining provisions apply only to the extent permitted by law; an invalid provision will not be expanded to create a broader restriction. Failure to enforce a provision once does not waive later enforcement. Separate clinical, financial, and privacy documents continue to govern their own subjects.
